# ZephyrusWare Acceptable Use And Data Policy **Version:** 1.0 **Effective date:** October 5, 2026 This Acceptable Use And Data Policy (the "**Policy**") is part of the ZephyrusWare Terms of Service for Personal Accounts and the ZephyrusWare Terms of Service (Business) (each, the "**Terms**"). It applies to everyone who uses the Services, which are provided by ZEPHYRUS VIRTUAL SOLUTION, LLC, a limited liability company organized under the laws of the State of Florida, doing business as ZephyrusWare ("**ZephyrusWare**", "**we**", "**us**" or "**our**"). For a Business Account, "you" includes your Authorized Users, and you are responsible for their compliance. Words with capital letters that this Policy does not define have the meaning they have in the Terms that apply to you. ## 1. About This Policy 1.1 **Part of your agreement.** This Policy is part of the Terms. You accept it when you accept the Terms, with the Terms checkbox, and ZephyrusWare records the version and a fingerprint of the exact text of this Policy that you were shown. If this Policy and the Terms differ on this Policy's subject, this Policy controls, except that the Terms control on warranties, liability, indemnity, governing law and courts. 1.2 **Your legal rights.** Nothing in this Policy takes away a right you have under law that cannot be waived or limited by agreement. ## 2. Acceptable Use 2.1 You must not: (a) use the Services in violation of law or the rights of others; (b) upload or share content that is unlawful, infringing, defamatory, harassing or malicious, including malware; (c) attempt unauthorized access to the Services, other accounts or related systems, or probe, scan or test their vulnerability without ZephyrusWare's written permission; (d) interfere with or disrupt the Services, including by excessive automated requests or by circumventing usage limits, license checks or security controls; (e) reverse engineer, decompile or copy protected parts of the Services, except as the law expressly permits; (f) use the Services to send spam or deceptive communications; or (g) use the Services to harm ZephyrusWare, its customers, users or others. 2.2 Schedule A and Schedule B add rules for Personal Accounts and Business Accounts. ## 3. Prohibited Data 3.1 **Data you must not enter.** Unless a feature is expressly designed for it, and for a Business Account ZephyrusWare agrees in writing, you must not enter any of the following into the Services, including into free-text fields such as notes, comments, descriptions and support requests: (a) payment card numbers, card security codes or other card authentication data; (b) bank account credentials; (c) passwords, API keys, access tokens or other secrets; (d) government identification numbers, such as Social Security numbers; (e) health or medical information; or (f) other sensitive categories of personal information that require special protection by law. 3.2 **Payment details.** Payment details may be entered only on the payment processor's hosted payment page. 3.3 **Automated checks.** The Services may automatically reject text that appears to contain restricted data. Those checks do not catch everything, and you remain responsible for complying with this Section. 3.4 **Regulated data.** The Services are not designed or offered for regulated health information or payment card data. ZephyrusWare makes no commitment that the Services meet any industry-specific or regulatory data standard unless it expressly agrees in a signed written agreement. ## 4. Enforcement 4.1 If you breach this Policy, ZephyrusWare may act under the Service Policy, including by suspending access or closing an account. ## 5. Changes To This Policy 5.1 ZephyrusWare may update this Policy. Each version has a version number and an effective date, and ZephyrusWare keeps every version available at https://zephyrusware.com/terms/acceptable-use-and-data-policy/, and each version has its own permanent page, for example https://zephyrusware.com/terms/acceptable-use-and-data-policy/1.0/. 5.2 For a material change, ZephyrusWare will email you (Personal Accounts) or your Tenant Admins (Business Accounts) at least 30 days before the new version takes effect, unless a change is required sooner by law or for security reasons. Changes that do not materially affect your rights take effect when published. 5.3 A material change to this Policy is accepted by ticking the box for the Terms again, which records the new version of this Policy. Until you do, the Terms and Section 9.3 of the Billing Policy say what happens to renewals. If you do not agree to a new version, you may cancel your Subscriptions before it takes effect, and the version you last accepted continues to apply until the end of your current paid term. ## 6. Personal Accounts A.1 In addition to Section 2.1, you must not: (a) use remote access, device management or similar features to reach a device or system you do not own or are not authorized to use; (b) resell, sublicense, rent or share the Services or your account with anyone else; or (c) use a product commercially where its Tier does not allow commercial use. ## Schedule B. Business Accounts B.1 In addition to Section 2.1, you and your Authorized Users must not: (a) resell, sublicense or provide the Services to third parties, except as an authorized Partner under a separate agreement; or (b) use the Services to build a competing product using ZephyrusWare's confidential information.
